PRIVACY POLICY PURSUANT TO ARTICLES 13 AND 14 OF THE GDPR
The company NQ ITALIA SRL., Data Processor pursuant to Art. 28 of EU Regulation 679/2016 (hereinafter also referred to as the ‘Data Processor’) with VAT number 01473720884, part of the Nova Quadri Group, a network of companies and legal entity based in Ragusa, industrial area III Fase, Viale 15 n. 2, VAT number 01797550884, Data Controller (hereinafter referred to as the ‘Controller’ or ‘Group’), pursuant to GDPR Regulation 2016/679, wishes to inform you about the type of data collected, the methods and purposes of processing such data, the rights you may exercise as a data subject and how to exercise them.
1. Categories of personal data processed
NQ ITALIA S.r.l. processes the personal data you provided when signing the
contract and acquired during the contractual relationship. In particular, the personal data
processed are as follows:
- 1.1 Personal details of the customer and any other members of the household and/or other persons with rights over the property covered by the contract, identity document, tax code/VAT number, residential address/registered office; contact details (telephone number, e-mail address)/company details.
- 1.2 Computer data (User ID and Password).
- 1.3 Correspondence with the customer via e-mail and/or post. Please note that some categories of data may not have been requested from the customer or may not have been acquired during the execution of the contract as they are not necessary for processing purposes.
2. Purposes and types of data processing and related legal bases
Please note that the data listed above will be processed for the following
purposes:
- Carrying out pre-contractual activities and fulfilling contractual obligations, managing customer relations;
- Compliance with legal obligations, regulations, EU regulations or requirements imposed by supervisory and/or control bodies and authorities;
- Pursuit of a legitimate interest of NQ ITALIA S.r.l.;
- Direct marketing purposes, subject to your consent.
In order to achieve the purposes listed above in points a) and b), the types of data processing implemented are listed below.

- NQ ITALIA S.r.l. may process and communicate to third parties, Data Controllers or external Data Processors appointed by the company (including, but not limited to, Public Administration, Deloitte, Banking Institutions, E-Distribuzione – GSE – Regione Sicilia, ENEA), its data for the fulfilment of contractual, Sicily, ENEA), for the fulfilment of contractual, accounting and tax obligations and for the fulfilment of measures by the judicial authorities aimed at the prevention and repression of crimes.
The provision of data is mandatory for the purposes referred to in points a) and b) and therefore
any refusal to provide them in whole or in part may make it impossible to
provide the services/performances requested. The communication of personal data does not
require the consent of the data subject if it is done in compliance with
legal obligations or to fulfil obligations arising from the contractual relationship
.
To achieve the purposes listed above in point c),
the types of data processing carried out are listed below.
- In pursuit of a legitimate interest of the Group, you may receive commercial communications, via the email address you have provided, concerning services similar to those covered by the contract. We inform you that with regard to the processing of data that may be carried out by the Group on the basis of its legitimate interest, the data subject has the right to object at any time by writing to the following email address: privacy@novaquadri.it. Following your objection, the Group will refrain from further processing such personal data, except where required by law.
To achieve the purposes listed above in point d),
the types of data processing carried out are listed below.
- For marketing purposes, with your express consent, some of the data listed in point i) may be processed by the Group for marketing purposes, i.e. for sending advertising material (by e-mail, post, or to the mobile number you have provided), and for carrying out market research on the Group’s services and/or products. The consent you have given may be revoked at any time by writing to privacy@novaquadri.it.
Your consent for the processing purposes referred to in point d) above is optional, but it may be used to send you updates and offers that may be of interest to you.
3. Data processing methods
Your personal data will be processed by authorised internal staff
using paper and electronic media. All
procedures and technical measures required for the protection of personal data
are implemented. Electronic media also include recordings made
by the switchboard for purposes related to pre-contractual and
contractual obligations.
4. Categories of recipients
Without prejudice to communications made in compliance with legal obligations,
all data collected and processed may be communicated
exclusively for the purposes specified above to the following categories of
data subjects:
- Companies belonging to the Data Controller’s network of companies, in their capacity as Data Processors;
- Entities that carry out activities on behalf of the Group, in their capacity as External Data Processors;
- Public or private entities with which collaborations are active for the purpose of providing the services agreed upon in the contract. A complete list of data processors is available by contacting privacy@novaquadri.it.
5. Retention period
The data required for contractual and accounting purposes will be stored, in accordance with
current legislation, by NQ ITALIA S.r.l. for a period not exceeding 10 years
following the conclusion of the contract. The data will be processed for marketing purposes
until you withdraw your consent for its use
for this purpose and in any case no later than 24 months from the date on which it was
expressed.
6. Rights of the data subject
Pursuant to European Regulation 679/2016 (GDPR), the data subject may, in accordance with
the procedures and within the limits provided for, exercise the following rights:
- request confirmation of the existence of personal data concerning him/her (right of access);
- know its origin;
- receive clear communication;
- obtain information about the logic, methods and purposes of the processing;
- request their updating, correction, integration, deletion, transformation into anonymous form, blocking of data processed in violation of the law, including those no longer necessary for the purposes for which they were collected;
- The data subject may request the deletion of their data by sending a written communication by e-mail to the data controller.
